GENERAL TERMS & CONDITIONS OF SALE, ONLINE ABSOLUTE AUCTION: Firearms from East Tennessee Estates

Buyer’s Premium
A 20% buyer’s premium will be added to the high bid. Example: For each $1,000 bid, a 20% buyer’s premium of $100 will be added to arrive at the total purchase price of $1,200.

Payment Terms
Payment must be made in US Dollars and must be made by SEPT 24 @ 2PM.
Once an item has been sold, it becomes the sole responsibility of the Purchaser. No items can be removed until a complete settlement has been made. The PAID receipt ticket will be required in order to remove items from the site. All checks should be made payable to Furrow Auction Company. “ALL SALES ARE FINAL”

Accepted Payment Methods
Wire Transfer, Company or Personal Check when accompanied by a Bank Letter of Guaranty, Cash or Cashier’s Check. Mastercard and Visa will have a 3% surcharge.

Order Of Sale
Items will be sold in numerical order. The highest bid at the specified closing time wins the lot. If a bid is placed within the final minutes, the system automatically extends the bidding timeframe, ensuring the auctions are always fair. The extended time may vary from auction to auction, normally between 1-2 minutes to place a higher bid. (Extended time is displayed.)

Sales Tax
No sales tax will be collected.

Claims
No Claims will be allowed after the removal of goods from the premises.

Registration
By registering as a Bidder and/or participating as a Bidder in the auction sale, Bidder is bound by the Terms & Conditions set forth. Bidder agrees that such Terms & Conditions are binding on the Bidder. Bidder agrees that Auctioneer is in control of the conduct of the auction sale and has the right to reject any bid by any Bidder. It is at the sole discretion of the Auctioneer as to whether or not any bid is in conformity with the Terms & Conditions of the auction sale. Furthermore, Auctioneer may refuse to accept a bid whenever in his sole discretion bid is not in good faith. ALL PERSONS must be registered to bid.

Inspection
Items are available for public inspection and the foregoing are merely guides. Bidders who are not present for the preview understand and acknowledge that they may not be able to inspect the item as well as if they examined it in person. Furrow Auction Company may attempt to describe the property in advertising, on the internet, and at the auction but makes no representations.

Notice To Inspect “As-Is, Where-Is”
Buyer’s decision to purchase should not be based solely on photographs. Auctioneer presents all information in catalogs and other advertisements from sources believed to be accurate. These are representations of the Auctioneer. Prospective Buyers should inspect all items to their own satisfaction. ALL ITEMS are being sold AS-IS-WHERE-IS with no warranty or guarantee-actual or implied. Furrow Auction Company will not be responsible for any errors or omissions in the description of the merchandise unless it is a material misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.

Removal
Auctioneer and Seller assume no responsibility for items once declared sold. Buyer is URGED to REMOVE ITEMS the day immediately following the auction upon Auctioneer receiving payment in full or to self-insure for potential loss. The buyer is responsible for the loading, removal, shipping, and transportation of all purchased items. If Furrow Auction Company does not receive full payment within 2 days of the end of the auction, interest on overdue amounts will be paid by the purchaser at a rate of 18% per annum or at such other maximum rate as allowed by law, together with any legal or collection costs incurred by Auctioneers. Furrow Auction Company reserves the right to resell items at its discretion due to non-performance of removal by the purchaser and the purchaser may be liable for any shortfalls, storage fees, or costs of transactions. Storage fees will apply on items left after scheduled removal.

The buyer is responsible for the loading, removal, shipping, and transportation of all purchased items.

Shipping of Firearms
Firearms will ship from Smoky Mountain Gun Shipping. If you are having firearms shipped to your local dealer:
You will need to email a copy of your dealer’s federal firearms license to smokymtngship@gmail.com, preferably with a copy of paid receipt, before the shipping process can begin. You will need to let SMGS know if you want to purchase insurance for your package. (More about insurance below.)

Once your dealers FFL license is received, SMGS will begin boxing items in order of ease to ship. SMGS will contact you with your total shipping cost with handling, which you can pay for over the phone via card or by mailing a check. Shipping will be the cost of postage + $35 handling fee. Each additional firearm is an additional $10 handling fee.

The insurance is thru the USPS or UPS depending on which carrier we think will be best price based on the packaging. Customers can expect pricing similar to anything else shipped from an online seller. If you are not sure if you want insurance, you have until the first call attempt for payment to decide to add insurance. If you do not send an email that they want insurance and do not answer the phone, TNGS will default to not insure.

SMGS will call from (865) 367-0705. Smoky Mountain Gun shipping will not be held liable for packages after they leave their presence.

NOTE: Shipping will take several days to get through everyone, TNGS can only ship a few firearms a day. There is no need for out of state customers to call, TNGS will be reaching out to you as soon as possible.

Out of state customers also have the option to pick up any long guns in person at the store as long as it is legal in their state. Handguns must be shipped to their local dealer in their state per TN law.

Condition of Items Sold
It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. In no event shall Furrow Auction Company be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Furrow Auction Company shall endeavor to describe in detail each item and any pertinent information about it.

Online Bidding Notice
To avoid any internet lags, Bidders are encouraged to place a maximum bid and let the computer bid for you. Furrow Auction Company is NOT responsible for any computer issues or malfunctions.

Online Bidding
Furrow Auction Company is providing internet pre-auction bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Furrow Auction Company or anyone else if the internet service fails to work correctly before or during the auction. Furrow Auction Company will not be responsible for any missed bids from any source. Furrow Auction Company reserves the right to withdraw or re-catalog items. Furrow Auction Company reserves the right to deny any person the right to bid online and may revoke the privilege at any point during the auction sale.
